1. Definitions and terms

Imisu – is the commercial name of S.C. CELO INDIVIDUAL TRADE S.R.L., a Romanian legal entity, having its registered office in Botoșani, Str. Bucovina No. 25, registered with the Trade Register under no. J07/360/2011, fiscal identification code 29229470.

Seller – Celo Individual Trade SRL.

Buyer – any individual, legal entity or other legal organization that creates an Account on the Website and places an Order.

User – any individual or legal entity registered on the Website who, by completing the Account creation process, has agreed to the specific clauses of the Website in the General Terms and Conditions section.

Account – the section of the Website consisting of an e-mail address and a password, which allows the Buyer to submit Orders and contains information about the Client/Buyer and the Buyer’s history on the Website, including orders, tax invoices, product warranties and other related data.

Website – the domain www.imisu.ro and its subdomains.

Order – an electronic document that acts as a form of communication between the Seller and the Buyer, through which the Buyer sends the Seller, via the Website, their intention to purchase Goods and Services from the Website.

Goods and Services – any product or service, including the documents and services mentioned in the Order, which are to be provided by the Seller to the Buyer as a result of the concluded Contract.

Content means:

• all information available on the Website that can be visited, viewed or otherwise accessed by using electronic equipment;
• the content of any e-mail sent to Buyers by the Seller through electronic means and/or any other available means of communication;
• any information communicated by any means by an employee or collaborator of the Seller to the Buyer, according to the contact information specified or not specified by the Buyer;
• information related to the Goods and/or Services and/or prices charged by the Seller during a certain period;
• information related to the Goods and/or Services and/or prices charged by a third party with whom the Seller has partnership agreements during a certain period;
• data related to the Seller or other privileged data belonging to the Seller.

Rating – a way for a User/Client/Buyer to express their level of satisfaction regarding a product. The rating is expressed in stars, each product being able to receive a score from one to five stars. This level of satisfaction will always be associated with the written review submitted by the User/Client/Buyer regarding a product or service.

Comment – an assessment or observation with a critical purpose, related to a Review or another comment.

Question – a request addressed to other Users/Clients/Buyers in order to obtain information about the products or services displayed on the relevant page.

Answer – written information sent to the User/Client/Buyer who asked a Question on the Website, on the page of a specific product. The answer represents an explanation provided by a User/Client/Buyer to another User/Client/Buyer within a discussion.

Document – these Terms and Conditions.

Newsletter – a periodic means of information, exclusively electronic, namely e-mail or SMS, regarding Goods and Services and/or promotions carried out by the Seller during a certain period, without any commitment from the Seller regarding the information contained therein.

Transaction – the collection or refund of an amount resulting from the sale of a Good and/or Service by imisu.ro to the Buyer, using the services of the card processor accepted by the Seller, regardless of the delivery method.

2. Online sales policy

The use of the Website www.imisu.ro, including visiting and purchasing products, implies acceptance of certain terms and conditions of use, in the form of a legal agreement between the User and Imisu. Therefore, we recommend carefully reading the following sections.

Visiting or purchasing products from www.imisu.ro automatically implies acceptance of these Terms and Conditions. The use of any current or future services provided by Imisu also implies acceptance of the same Terms and Conditions.

2.1 General information about products and prices

Imisu makes continuous efforts to maintain the accuracy of the information presented on this Website. However, considering possible errors regarding this information, we specify that the images displayed on the Website are for informational purposes only and may contain accessories not included in the standard packages. Some features or prices of the products displayed on the Website may be changed without prior notice, may contain operational errors or may be incomplete.

The descriptions displayed on the Website are for recommendation purposes only. Before replacing any part, we recommend performing a specialized diagnosis in order to correctly identify the defect.

We make every effort to present the most relevant information correctly. We apologize for any possible information errors and kindly ask you to report any potential error to: suport@imisu.ro.

All promotions displayed on the Website are valid while stocks last.

Customers of www.imisu.ro will always be informed whether a product is in stock, whether it can be ordered, how long it will take to process the order and how long delivery will take.

This information will be communicated by e-mail or phone. Product images, offers, prices and contests may be changed beforehand without specific notice.

Products sold through www.imisu.ro may be new or second-hand and, upon delivery, will always be accompanied by a tax invoice or fiscal receipt.

2.2 Use of cookies

Imisu personalizes the content of web pages according to the type of browser used and other information, through cookies. Cookies are not executable code; therefore, they do not perform any operations and do not contain software, viruses or spyware. They cannot access information from the user’s hard drive.

Cookies make it possible to recognize users’ devices and present content adapted to their preferences. A cookie does not collect personal information from visitors, but rather acts as a mechanism for retrieving data.

For example, these cookies help us provide visitors with better and easier navigation on the Website, such as keeping the shopping cart active until the next visit, without the user having to add again the products they want to order or save in the shopping cart.

The information we collect is used to provide relevant online advertising for our users, promoted on Google or other websites visited by our customers. We may also collect other information, such as where users see our promoted ads and which ads they access.

We collect such information for remarketing campaigns through Google AdWords Remarketing, which keeps track of users who access www.imisu.ro or a similar audience. The information we collect about the users of our Website is used only for our remarketing campaigns, and Imisu will not make this information public.

2.4 Return policy

According to the law, the consumer has the right to unilaterally withdraw from the order by notifying us in writing or by phone that they withdraw from the purchase, without penalties and without stating a reason, within 14 days from receiving the product.

The consumer has the obligation to read the Return Policy before purchase. Acceptance of the Terms and Conditions implies acceptance of the store’s Return Policy.

Before returning products, please contact us at suport@imisu.ro and mention in your message the order number from which you wish to return products.

The products must reach our possession, be checked, and then you will be informed of the response to your return request. Within a maximum of 14 days from the return date, you will receive the value of the returned order or products.

Parcels returned without prior written notification will not be accepted. Products that show physical changes, signs of use for new products, broken warranty seals or products that do not comply with the Return Policy will not be accepted for return.

Refunds will be made only to the bank account specified by the customer in the submitted notification.

2.5 Warranty policy

The warranty period for each product is specified on the product page.

The consumer has the obligation to read the Warranty Policy before purchase. Acceptance of the Terms and Conditions implies acceptance of the store’s Warranty Policy.

To benefit from the warranty, please contact us at suport@imisu.ro and mention in your message the order number and the product or products for which you request warranty service.

The products must reach our possession, be checked, and then you will be informed of the response to your warranty request. Within a maximum of 15 days from receiving the products under warranty, they will be repaired, replaced with other products or, if this is not possible, the price paid for the product will be refunded.

Products sent for warranty without prior written notification will not be accepted. Products that show physical changes, signs of improper use, broken warranty seals or products that do not comply with the Warranty Policy will not be accepted for warranty processing.

3. Ownership rights

3.1 Copyright

All content of www.imisu.ro, including text, graphics, images, buttons, clips, scripts, programs and any other data, is the property of Imisu and/or its associates, partners and/or suppliers and is protected in accordance with copyright law.

The graphics, emblem, header and images on www.imisu.ro may not be used in connection with products or services that do not belong to Imisu, in a way that may create confusion among customers or discredit www.imisu.ro.

3.2 Use of the Website

Accessing, visiting, using or purchasing the products and services displayed on www.imisu.ro implies acceptance of these Terms and Conditions.

Registration as a user of this Website represents your implicit agreement to receive electronic and phone messages related to the products sold. This can be changed or cancelled later without any penalty for the customer.

3.3 Access to the Website

Imisu allows unlimited access to www.imisu.ro for personal purposes, but does not grant the right to download, modify in whole or in part, or reproduce the Website in whole or in part without the written consent of Imisu.

3.4 Correction of incorrect information

We reserve the right to correct any omissions or display errors that may occur as a result of drafting mistakes, lack of accuracy or software product errors, without prior notice.

We disclaim any liability for any situation that may arise due to software errors or technical failures occurring on the server. Imisu assumes no responsibility for loss of information caused by any malfunctions or errors of the software used to build and host the Website, nor does it guarantee that the Website, the server or the e-mails sent by www.imisu.ro do not contain viruses or other harmful components, although we make every effort to prevent this.

3.5 Disputes, conflicts and litigation

Any attempt of unauthorized access to www.imisu.ro and any attempt of fraud will be reported to the competent authorities.

By using the Website, including visiting or purchasing products, the User agrees that Romanian law shall govern these Terms and Conditions and any dispute of any kind that may arise between the User and Imisu.

For any defect found after purchasing a product from www.imisu.ro, the Buyer may request, according to Government Decision no. 665/1995, Articles 5 and 6, the repair or replacement of the defective product. This will be done after the Buyer presents the product and after an Imisu representative confirms the claimed defect.

Any dispute arising between Clients and Imisu will be resolved amicably. If this is not possible, disputes will be settled by the competent Romanian courts.

3.6 Changes

Imisu reserves the right to make changes at any time to the content of www.imisu.ro, its policy, terms and conditions of use, without prior notice to users, although we will make efforts to inform customers about such changes.

The user of www.imisu.ro has the obligation to regularly check the Terms and Conditions of use. If the user does not agree with the changes made by Imisu, they must stop using the Website. If the user continues to use the Website, they are deemed to agree with the changes made.

4. Newsletter subscription and unsubscription

Subscribing and unsubscribing to the www.imisu.ro newsletter is free and voluntary and implies acceptance of the following terms of use.

The messages sent are not unsolicited, and you can unsubscribe at any time by following the instructions at the bottom of each e-mail.

The messages sent comply with the law on electronic commerce regarding commercial communication, as provided by Romanian and international legislation.

5. Confidentiality

Imisu adopts a strict policy regarding the confidentiality of customer data.

The merchant guarantees the security and confidentiality of the data hosted and transmitted through its IT system. This information may be used by the Merchant to send the user order confirmations, various special offers, promotions and other similar communications only with the customer’s prior consent.

Providing personal data to the Merchant is not mandatory for users. Users may refuse to provide such data under any circumstances and may request, free of charge, the deletion of such data from the database.

Any such request or notification regarding the deletion of personal data from the database shall be sent to Imisu by the person registered in the database by e-mail at: suport@imisu.ro.
